Bam Margera’s lawsuit against the production of Jackass Forever is reportedly moving forwards in the court process.
According to The Hollywood Reporter, L.A. judge Robert S. Draper gave the go-ahead on Friday (December 17) for the case to move onto the next stage. The decision comes despite multiple motions to dismiss the lawsuit entirely.
In his ruling, Draper reportedly found Margera’s claims to have a “probability of success”, stating: “Defendants might ultimately prevail as this case continues, but the claims have a minimal merit, and plaintiffs should have an opportunity to conduct discovery to identify certain examples of orally developed ideas that were actually used in the film.”
Margera filed his claim against multiple parties involved in the making of Jackass Forever including Paramount Pictures, Jeff Tremaine, Spike Jonze, and Johnny Knoxville.
The suit, which was filed in August, alleges that Margera was wrongfully removed from the project after failing to adhere to all the conditions listed in his contract. Among them were requirements that he take regular drug tests, attend rehab, take prescribed medication in the presence of a witness, and submit to a breathalyzer test three times a day.
While the lawsuit may ultimately affect the release of Jackass Forever, the film is currently scheduled for release on February 4, 2022.
